Victory Veterans Claims Agency 100% Rating Guarantee Policy
1. Scope of the Guarantee
• Veterans filing their first-ever VA disability claim with VVCA who do not achieve a 100% disability rating after the initial claim are eligible for the 100% Rating Guarantee.
• Under this policy, VVCA will provide one free appeal or claim submission per year for up to five years, or until the 100% rating is achieved, whichever comes first.
2. Eligibility Requirements
To qualify for the 100% Rating Guarantee, the veteran must meet the following conditions:
1. First-Time Claimant:
• The veteran must be filing their first-ever VA disability claim. Veterans with existing VA ratings, prior claims, or claims submitted through other representatives are not eligible.
2. Documentation:
• The veteran must provide complete and accurate documentation, including:
• DD-214 (discharge papers)
• All relevant medical records
• Service treatment records and other supporting evidence
• Missing documentation may result in delayed eligibility or exclusion from the guarantee.
3. Service Connection:
• The claim must involve service-connected disabilities. Secondary claims or non-service-connected conditions are excluded from the guarantee.
4. Timely Onboarding:
• Veterans must complete the onboarding process, including signing VVCA’s service agreement and submitting all required forms, within 30 days of their consultation.
5. Pre-Approval Screening:
• VVCA will conduct a preliminary eligibility review of the veteran’s case to determine the likelihood of achieving a 100% rating.
• Cases deemed unlikely to reach 100% due to insufficient evidence or other factors may be excluded from the guarantee.
6. Good Standing:
• Veterans must remain in good standing with VVCA by:
• Paying any applicable fees.
• Responding to communications within a reasonable timeframe.
• Attending all scheduled medical evaluations (e.g., C&P exams).
3. Limitations and Conditions
1. Timeframe:
• The guarantee is valid for up to five years from the date of the initial claim submission. After five years, no further appeals will be covered under this policy.
2. Appeal Limit:
• Veterans are entitled to one free appeal or claim submission per calendar year under this guarantee, up to a maximum of three appeals within the five-year period.
3. Evidence Requirement:
• VVCA will only proceed with appeals if new or additional evidence is provided to strengthen the case. It is the veteran’s responsibility to obtain and submit this evidence.
4. Non-Cooperation Clause:
• The guarantee will be voided if the veteran:
• Fails to attend required medical evaluations or VA-requested appointments.
• Misses deadlines or refuses to provide requested documentation.
• Does not respond to VVCA communications in a timely manner.
5. Fee Structure:
• The standard backpay fee (20% of backpay) remains payable upon the successful award of benefits for the initial claim. Subsequent appeals or claims under this guarantee will not incur additional fees.
6. Exclusions:
• Claims involving fraudulent information or deliberate misrepresentation of service-connected conditions.
• Non-service-connected conditions or secondary claims unrelated to the original submission.
4. Additional Services for Complex Cases
• Veterans with complex cases (e.g., secondary conditions, high-level appeals to the Board of Veterans’ Appeals) may choose to enroll in VVCA’s Premium Appeals Package, which offers additional services, including:
• Case strategy consultations with senior claims specialists.
• Expedited processing for time-sensitive appeals.
• A discounted flat fee for advanced support.
5. Disclaimers
• VVCA will make every effort to assist veterans in achieving their 100% rating. However, this guarantee does not constitute a promise of specific results or approval timelines. The VA retains sole authority over disability ratings and benefit decisions.
• This guarantee is contingent on the veteran’s active cooperation and provision of evidence. Failure to comply with these responsibilities voids the guarantee.
• VVCA reserves the right to terminate the guarantee if the veteran violates the terms and conditions or engages in fraudulent activity.
6. Force Majeure Clause
•VVCA is not responsible for delays or adverse outcomes caused by factors beyond its control, including changes in VA policies, force majeure events, or other unforeseen circumstances.
